1. Overview

This website is operated by Holistiq IQ LLC. Throughout these Terms of Service, “Holistiq IQ,” “we,” “us,” and “our” refer to Holistiq IQ LLC.

These Terms of Service govern your access to and use of holistiqiq.com, including its content, features, products, services, and purchasing functions, collectively referred to as the “Services.”

Our online store is hosted through Shopify, which provides the e-commerce platform that allows us to offer products and Services to you. Your contract for purchases made through this website is with Holistiq IQ LLC.

By visiting our website, creating an account, placing an order, or otherwise using the Services, you agree to these Terms of Service and any additional policies incorporated into them, including our Privacy Policy and Return & Refund Policy.

If you do not agree to these Terms of Service, you may not use the Services or purchase products from our website.

2. Eligibility and account responsibility

You must be at least 18 years old or the legal age of majority in your jurisdiction, whichever is greater, to create an account or place an order.

By using the Services, you represent that:

  • You meet the applicable age requirement

  • You have the legal capacity to enter into a binding agreement

  • The information you provide is accurate, current, and complete

  • You will use the Services only for lawful purposes

If you create an account, you are responsible for maintaining the confidentiality of your login information and for all activities conducted through your account. Notify us immediately at holistiqiq2025@outlook.com if you believe your account has been accessed without authorization.

We may refuse service, suspend an account, cancel an order, or limit access to the Services when reasonably necessary to address suspected fraud, unlawful conduct, security threats, violations of these Terms, or risks to Holistiq IQ or its customers.

3. Health and dietary-supplement disclaimer

Information provided through the Services is for general informational and educational purposes only. It is not medical advice and is not intended to replace advice, diagnosis, or treatment from a qualified healthcare professional.

Always read and follow the product label, directions, ingredients, allergen information, warnings, and recommended serving instructions before using a dietary supplement.

Consult a qualified healthcare professional before using any supplement, particularly if you:

  • Are pregnant or nursing

  • Are under 18 years of age

  • Take prescription or over-the-counter medication

  • Have a known or suspected medical condition

Nothing in this section limits any rights or remedies that cannot lawfully be limited.

4. Product information

We make reasonable efforts to present accurate product descriptions, ingredients, suggested uses, warnings, images, availability, and pricing. However, product packaging, labels, colors, appearance, and other details may differ slightly from what appears on your screen.

Manufacturers may update product packaging, ingredients, or formulations. You are responsible for reviewing the label on the product you receive before using it. If the delivered label appears materially different from the website description or you have questions about an ingredient, do not use the product and contact us.

Products and Services may be available exclusively online and may have limited quantities. We may modify, discontinue, or limit a product prospectively at any time, subject to fulfilling or refunding existing orders as required by law.

A product’s availability on the website does not guarantee that it will remain available or that an order will be accepted.

5. Orders and order acceptance

Submitting an order is an offer to purchase. An automated order confirmation acknowledges that we received your order but does not necessarily mean that the order has been accepted.

We may accept, decline, limit, or cancel an order for legitimate reasons, including:

  • Product unavailability

  • Pricing or description errors

  • Suspected fraud or unauthorized payment

  • Quantity or purchasing limits

  • Shipping or import restrictions

  • Suspected commercial resale

  • Violation of these Terms

  • Legal or regulatory requirements

We may limit quantities purchased per person, account, household, payment method, billing address, shipping address, or order.

Unless we provide written authorization, products purchased through our retail website are intended for personal use and not for commercial resale.

If we cancel an order after payment has been collected, we will issue a refund to the original payment method. We will not charge you a higher price than the amount you authorized without first obtaining your consent.

6. Prices, billing, and payment

Prices are displayed in the currency shown on the website at the time of purchase. Unless stated otherwise, displayed product prices do not include shipping charges, taxes, customs duties, or other charges that may be calculated at checkout.

Prices, promotions, and product availability may change prospectively without notice. These changes will not alter the price of an order that we have already accepted, except when you agree to the change or applicable law permits it.

You agree to provide accurate and complete billing, payment, shipping, and contact information. You also agree to promptly update information necessary to complete your order.

By providing a payment method, you represent that you are authorized to use it and authorize us and our payment processors to charge the amounts displayed at checkout.

Your bank, card issuer, or payment provider may impose currency-conversion, international-transaction, or other fees. These charges are imposed by the provider and are not controlled by Holistiq IQ.

7. Subscriptions and automatic renewals

This section applies only when a product is expressly offered as a subscription, recurring order, automatic renewal, or continuous service.

Before you enroll, the checkout process will disclose the subscription’s price, billing frequency, renewal terms, minimum commitment—if any—promotional terms, and available cancellation methods.

By affirmatively selecting a subscription and completing your purchase, you authorize Holistiq IQ or its payment processor to charge your selected payment method automatically at the disclosed frequency until you cancel.

You may cancel an online subscription through the cancellation controls available in your account or by contacting holistiqiq2025@outlook.com. We will not require you to use a cancellation method that unreasonably obstructs or delays cancellation.

To avoid the next renewal charge, submit your cancellation before that charge is processed. Cancellation applies to future renewals. If a renewal order has already been processed or shipped, our Return & Refund Policy will apply to that order.

We will provide order confirmations, renewal reminders, promotional-expiration notices, price-change notices, and other disclosures when required by applicable law. Material changes to subscription terms will be communicated before they take effect.

Canceling a subscription does not automatically refund products previously delivered or charges already validly processed.

8. Shipping and delivery

Shipping costs and available delivery methods are displayed during checkout based on the order and destination.

Processing, shipping, and delivery dates are estimates unless we expressly identify a date as guaranteed. Carrier delays, weather, customs processing, supply interruptions, incorrect addresses, and circumstances outside our reasonable control may affect delivery.

You are responsible for providing a complete and accurate delivery address. Additional shipping charges resulting from an incorrect or incomplete address may be your responsibility when permitted by law.

If we cannot ship within the timeframe stated when you ordered—or within the period required by law when no timeframe was provided—we will give you any legally required notice and the opportunity to agree to the delay or cancel the unshipped order for a refund.

International orders may be subject to customs inspections, import restrictions, duties, taxes, brokerage charges, or other destination-country requirements. Unless checkout states that these charges are included, the recipient is responsible for them.

We may decline or cancel an international order when shipping or importing the product is unavailable, restricted, or reasonably believed to be unlawful.

9. Returns and refunds

Returns, exchanges, damaged products, nonreturnable products, and refunds are governed by our Return & Refund Policy, which is incorporated into these Terms.

If these Terms conflict with the Return & Refund Policy on a return-specific issue, the Return & Refund Policy will control, subject to any mandatory rights provided by applicable law.

10. Promotions, discounts, and gift cards

Discounts, promotional codes, giveaways, free gifts, and special offers may be governed by additional terms disclosed with the promotion.

Unless otherwise stated:

  • Promotional offers cannot be combined

  • Promotional codes have no cash value

  • Promotions may be limited by product, customer, location, quantity, or date

  • Discounts cannot be applied retroactively

  • Promotions may be modified or canceled before acceptance when reasonably necessary to correct an error, prevent fraud, or comply with law

Gift cards are subject to any terms presented when purchased and applicable gift-card laws.

11. Errors, inaccuracies, and omissions

Our website may occasionally contain typographical errors, inaccuracies, or omissions involving product descriptions, prices, promotions, availability, shipping charges, or delivery estimates.

We may correct errors and update information at any time. If an error affects an order you submitted, we may contact you for instructions or cancel and refund the affected order.

We will not replace an accepted product with a materially different product or charge an increased price without your consent.

12. Intellectual property

The Services and their contents—including the Holistiq IQ name, logos, trademarks, product presentation, graphics, photographs, videos, text, designs, page layouts, and other materials—are owned by or licensed to Holistiq IQ LLC and are protected by applicable intellectual-property laws.

We grant you a limited, personal, nonexclusive, nontransferable, and revocable license to access and use the Services for lawful, noncommercial purposes.

Without our prior written permission, you may not:

  • Copy, reproduce, republish, distribute, sell, or commercially exploit website content

  • Use Holistiq IQ trademarks, branding, or product images

  • Create misleading or unauthorized advertising using our materials

  • Frame, mirror, scrape, or systematically extract website content

  • Modify or create derivative works from protected content

  • Suggest an affiliation, sponsorship, or endorsement that does not exist

No ownership rights are transferred to you through your use of the Services.

13. Reviews, feedback, and other submissions

If you submit a review, photograph, testimonial, comment, suggestion, or other content, you retain ownership of your original content.

You grant Holistiq IQ a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, adapt, publish, display, and distribute that content in connection with operating, improving, and promoting Holistiq IQ and its products.

You represent that:

  • You own the content or have permission to submit it

  • The content reflects your honest experience or opinion

  • The content does not infringe another person’s rights

  • The content is not fraudulent, deceptive, defamatory, threatening, obscene, or unlawful

  • You will disclose any material relationship, payment, discount, or free product connected to the submission

We may moderate or remove content that violates these Terms, applicable law, or our reasonable content standards. We are not required to publish every submission.

Do not submit confidential information, medical records, or sensitive personal information through a public review.

14. Third-party services and links

The Services may contain links to third-party websites, applications, payment processors, shipping carriers, social-media platforms, or other services.

Third-party services are governed by their own terms and privacy policies. A link or integration does not necessarily constitute an endorsement.

To the fullest extent permitted by law, Holistiq IQ is not responsible for third-party websites, content, security practices, products, services, or transactions that are outside our control. Review the applicable third-party terms before using those services.

15. Privacy and electronic communications

Our collection, use, and disclosure of personal information are described in our Privacy Policy.

By placing an order or creating an account, you consent to receive transactional communications necessary to administer your order or account, including confirmations, receipts, shipping updates, safety notices, and customer-service messages.

Marketing communications are separate. You may unsubscribe from promotional emails using the unsubscribe link provided in the message. Unsubscribing from marketing does not prevent necessary transactional or legal communications.

16. Prohibited uses

You may not use the Services:

  • For any unlawful, fraudulent, or deceptive purpose

  • To violate any applicable law or regulation

  • To infringe intellectual-property, privacy, publicity, or other legal rights

To the extent permitted by law, you agree to indemnify and hold harmless Holistiq IQ LLC and its officers, members, employees, agents, and service providers from third-party claims, liabilities, losses, and reasonable expenses arising from:

  • Your material violation of these Terms

  • Content you submit that violates another person’s rights

  • Fraudulent or intentionally harmful conduct committed through your account

This obligation does not require you to indemnify Holistiq IQ for its own negligence, unlawful conduct, or wrongdoing.

20. Suspension and termination

You may stop using the Services at any time.

We may suspend or terminate your access if you materially violate these Terms, use the Services unlawfully, create a security risk, engage in fraud, or harm Holistiq IQ or another person.

Termination does not eliminate payment obligations, liabilities, or rights that arose before termination. Provisions that reasonably should survive termination—including intellectual property, liability limitations, indemnification, and governing law—will remain effective.

21. Events outside our reasonable control

We are not responsible for delays or failures caused by events outside our reasonable control, such as natural disasters, severe weather, labor disruptions, carrier interruptions, government actions, public-health emergencies, power failures, cyberattacks, or supply-chain interruptions.

This section does not excuse obligations that cannot legally be avoided, including required customer notices or refunds.

22. Governing law and disputes

These Terms and your use of the Services are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles.

Unless applicable law permits or requires a different location, legal proceedings relating to these Terms or the Services may be brought in the state or federal courts located in Los Angeles County, California.

If you are a consumer residing outside California, nothing in these Terms deprives you of mandatory consumer protections or dispute rights provided by the laws of your place of residence.

23. Severability, waiver, and entire agreement

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed, and the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver of our right to enforce it later.

These Terms and the policies incorporated into them constitute the entire agreement between you and Holistiq IQ concerning the Services and replace prior communications relating to the same subject.

Headings are provided for convenience and do not affect interpretation.

24. Changes to these Terms

We may update these Terms from time to time to reflect changes to our Services, business practices, or legal obligations.

The Terms in effect when an order is placed will generally govern that order unless you agree to an updated version or applicable law requires a different result.

Your continued use of the Services after updated Terms become effective constitutes acceptance of those updated Terms.
